Minimum Advertised Price Agreement & Policy

The resale of all Health Genesis Corporation products for the brands (e.g., Athlet, Biogenuine, Biophix, Femalean, Health Genesis, Sowers Organics, US Metabolics, and Vitabolics) are subject to the brand’s Minimum Advertised Price (MAP) policy. Resellers that do not adhere to the MAP policy risk, are compromising the perceived value of Health Genesis Corporation products. Companies authorized to sell Health Genesis Corporation products must agree to the terms set forth on this website or written agreement.

Health Genesis Corporation’s MAP policy includes the following guidelines:

The MAP for all Health Genesis Corporation brands (e.g., Athlet, Biogenuine, Biophix, Femalean, Health Genesis, Sowers Organics, US Metabolics, and Vitabolics) products must not be less than our retail line or web price. Health Genesis Corporation may adjust its Minimum Advertised Price at any time and will notify the reseller of any changes in writing (via email, website, letter, or price list).

This policy applies to all Health Genesis Corporation product advertisements in all media. This includes but is not limited to posters, coupons, flyers, magazines, billboards, catalogs, television, radio, and internet (as well as other electronic media).

Health Genesis Corporation monitors the use of copyrighted materials (photographs, images, text, trademarks, and logos) in the promotion and sale of its products.

The MAP applies exclusively to advertised prices, as well as the price at which Health Genesis Corporation products are sold to an individual consumer at the reseller’s retail store or by other means.

The MAP policy does not limit the reseller’s ability to advertise that they “have the lowest prices,” that they “will price-match their competition,” that consumers should “call for a price,” or similar phrases so long as the advertised price reflects or exceeds the MAP. If pricing is displayed in other than a brick-and-mortar retail store, any strike-through or other alteration of the Minimum Advertised Price is prohibited.

Health Genesis Corporation will not conduct business with representatives who compromise the image of its products. Failure to adhere to this policy—intentional or recurring—will result in termination of the reseller’s Health Genesis Corporation account. Health Genesis Corporation will determine whether to provide prior notice or issue warnings before taking such action.

Marketplace Policy:

For auction websites such as eBay, “Buy it Now” options must be equal to or greater than the MAP. All reserve or opening bids must start at the MAP amount without a “Buy it Now” option. Health Genesis Corporation prohibits “Best Offer” auctions.

Health Genesis Corporation products may not be listed for sale on Amazon without prior written authorization.

On occasion, Health Genesis Corporation may offer the reseller written approval to sell certain products below the MAP amount. The discount amount and duration will be determined by and/or subject to the approval of Health Genesis Corporation. Health Genesis Corporation may run a sale on a periodic basis; in such cases, the MAP will reflect the sale price on the relevant items on the specified dates. Health Genesis Corporation will provide prior written notice with details on the promotion.

MAP Policy Agreement: A copy of Health Genesis Corporation’s MAP policy will be provided to each new reseller. The policy must be signed and returned to Health Genesis Corporation at the reseller’s earliest convenience. From there forward, the reseller must adhere to the MAP policy.

Health Genesis Corporation established its MAP policy to safeguard the reputation of its brands and products. The policy is designed to encourage competition for the sale of Health Genesis Corporation brands and products in a manner that reflects consumers’ long-term interests.
